Michael Jordan Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a Charlotte court on Friday, stated that his drive to win and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his racing venture, saying he invested $40 million of his own funds into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. I felt as far as the sport it needed to be looked at from a different view.”

Central Issue: Franchise System and Contract Pressure

The heart of the case involves the end of a 2016 deal where Nascar provided each team a franchise. This system mirrors other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for about sixty minutes and exited the courthouse to pandemonium, with fans and media clamoring for a glimpse or a picture of the global icon.

Leading the Legal Charge

23XI Racing is leading the full-court press along with Front Row Motorsports for Nascar to overhaul a business model Jordan contended is breaking the law to maintain excessive control.

At issue for Jordan and a fellow team representative, who testified before Jordan, are details from September 2024. She recounted a frantic and emotional period where the sanctioning body told teams they had to sign a contract extension. The document spanned over a hundred pages outlining team compensation and a guaranteed entry in every race.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. The other 13 organizations agreed to the terms.

The team owners reached out to Nascar about possible changes or negotiations. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Winning

Ultimately, the pushback against what he saw as a unsustainable system was driven by the usual bottom line for Jordan: Winning.

“Denny convinced me adding a third car improved our chances to win,” he said, noting that he purchased another franchise late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She testified the pressure of the contract signing demand didn’t sit well.

She said, Joe Gibbs first tried to call and persuade Nascar against demanding signatures, but Nascar’s leader refused the appeal.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If there are 30, I have 30.”
