Andrej Babiš, the self-proclaimed billionaire who secured victory in the recent Czech election, has declined to sell his extensive corporate assets, while insisting he will address a ethical dilemma that could block him from assuming the position of prime minister.

Stance on Business Holdings

Babiš, whose ANO party emerged victorious in the autumn election but did not secure a majority in parliament, declared in a social media post that he would not divest his Agrofert conglomerate, which is active in agriculture, food production, and chemical industries.

“I have consistently stated I will not sell Agrofert. I have repeatedly stated I will address the ethical issue in accordance with national and European laws,” Babiš commented. “This is different from selling a roll in a bakery.”

Head of State's Requirement

The Czech president, Petr Pavel, announced that the elderly populist must publicly explain how he will eliminate ethical conflicts arising from his corporate dealings before being appointed premier.

The national charter “explicitly requires the head of state to take into account the possible emergence of a ethical issue and the ways to address it” when selecting government ministers, the presidential administration explained.

The president “wants it to be clear in what specific way Andrej Babiš will meet his statutory duties”, the announcement said, noting that Pavel was prepared to designate Babiš as premier “immediately” once the issue was settled.

Business Operations and Legal Issues

Babiš's numerous firms, mostly under the Agrofert group, function in the nation and other regional countries, receiving millions of euros in domestic and European agricultural and other subsidies, as well as public contracts.

Under national legislation, cabinet members are barred from receiving state support or agreements. The ethics organization Transparency International has stated that to avoid a ethical breach, Babiš must either sell, decline government deals, or stay out of public office.

Previous Term and Present Intentions

Babiš affirmed he would “abide by the regulations” if selected as premier, but declined to detail how in advance because the matter was “an extremely sensitive and personal matter for me, and the media will always question me regardless”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš faced several legal battles and an EU investigation over possible conflicts of interest. He temporarily moved his holdings into fiduciary arrangements, while keeping certain control over them.

A court and the EU executive both determined that this did not suffice. Babiš stated recently that he was once more the sole owner of Agrofert and maintained he was “implementing measures” to prevent a ethical problem, but declined to reveal details.

Governing Agreement and Foreign Policy Implications

The wealthy politician has signed a governing pact with two minor right-leaning groups, the ultra-conservative, pro-Russian SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has primarily campaigned against the EU’s Green Deal.

The new government, if approved, is expected to bolster the populist bloc in central and eastern Europe and might challenge backing from Western nations for Ukraine – even though Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to assure him of the nation's backing.

Pavel, who as head of state shares responsibility for international relations, also demanded that the coalition’s programme add a declaration on the government’s position on Russia’s war in Ukraine, including a commitment to meeting Nato obligations.

The president has previously said he would not endorse any cabinet candidates who might question the nation's international alliances, a condition that the far-right SPD has indicated it will meet by proposing non-partisan experts.
